TERMS AND CONDITIONS for the
"PIMP MY ORC" contest on the following web site :
www.pimp-my-orc.com

1. ORGANISATION
Ascaron Entertainment (UK) Ltd (hereafter referred to as Ascaron) is a limited company, registered in England and Wales, under the registered office address Hereford House, 112 High Street, Coleshill, Warwickshire, B46 3BL. Registration No. 4538029. Ascaron openly invites internet users, under no obligation, with no purchase necessary, to freely participate in an online contest entitled "Pimp My Orc" (hereafter referred to as the "Contest"), located on the website: www.pimp-my-orc.com. The Contest begins 1st December 2007 at noon (12:00) and ends 31st January 2008 at 23:59. This Contest, organised by Ascaron, requires Participants to submit their graphical entries through www.pimp-my-orc.com in order to have the opportunity of winning prizes, as described in Section 5, under the terms and conditions hereof. Ascaron accepts no liability for the submission of inappropriate images, in terms of their suitability and of their copyright status. Any entries deemed inappropriate by Ascaron will be deleted from the Contest, and the Participant will be disqualified from the Contest. Failure to abide by the terms and conditions of the Contest will result in the disqualification of the Participant.

2. CONTEST ENTRY

2.1 Entry Requirements
Participation in the Contest is solely available via www.pimp-my-orc.com.
Participants of this Contest must be:
- Aged 18 years or older, or have the consent of either parent or legal guardian
- Resident in the UK and Ireland
- In possession of access to the internet and a permanent email account
Ascaron, Saitek and Nobilis FRANCE employees and their relatives are prohibited from entering into the Contest.

2.2 Contest Behaviour
Ascaron reserves the right to exclude from participation in the Contest at any time, without notice, any person(s) who, through whatever means, is deemed to have gained unfair advantage in the Contest.
Ascaron reserves the right to exclude from the Contest any user who submits entries whose content is violent, pornographic, religious, political, racist, or considered to be prejudicial to morality and public order.

2.3 Cancellation of Entry
At any time during the Contest, the Participant may cancel their participation and withdraw his or her previous entries by sending an email to Ascaron at the following address: contact@pimp-my-orc.com, and specifying the name, surname and email address of the entry.

2.4 Data Protection
Ascaron will not pass on any data submitted by Participants during the course of the Contest to third parties without the prior consent of the Participant.

3. CONTEST MECHANICS
The Contest requires Participants to submit a graphic incorporating the illustrations provided on www.pimp-my-orc.com.
Each graphic must be in the format "JPEG or JPG" and have a maximum resolution of 800x600 pixels, and a maximum file size of 500k.
The jury is composed of employees of Ascaron. The Contest winner will be notified by email no later than 8th February 2008 (to the address provided during submission of entry) and the winning graphic will be exhibited on www.pimp-my-orc.com.

4. DURATION
The Contest begins 1st December 2007 at noon (12:00) and ends 31st January 2008 at 23:59 The competition winner will be announced 1st February 2008.

5. PRIZES
The winner will receive a copy of Fantasy Wars on PC DVD-ROM, a Saitek Cyborg Mouse, a Saitek Cyborg Command Unit and a Saitek Cyborg Headset.
Ascaron reserves the right to, without notice or explanation, modify any or all of the prizes offered. In the event of this, Ascaron will endeavour to replace item(s) with a similar item or items, equal to or greater in value.
Prizes will be accepted as advertised on www.pimp-my-orc.com. No cash alternative is offered. Prizes may not be exchanged, returned by the Contest winner.
All entries are welcome. However, prizes can only be shipped to a resident in the UK
Subject to availability, prizes will be dispatched within 28 days of the announcement of the winner

6. RESPONSIBILITY
Ascaron reminds all Participants that entry into the Contest implies the knowledge and acceptance of the characteristics and limitations of the internet, with particular regard to technical performance, potential non-delivery of submission, querying and transferring information, the risk of interruption, and more generally, the risks inherent in any connection and transmission through internet, including the lack of protection of data against possible misuse and the risk of virus contamination.
Under no circumstances can Ascaron be held responsible for, but not limited to, the transmission and receipt of data, and/or information through the internet, any malfunction of the internet, or any other digital means which prevents the operation of the Contest, the failure of any reception equipment or communication lines, loss of any paper or electronic mail, and more generally, loss of any data.

7. DECISIONS
Ascaron reserves the right to, at any time and without prior notice, change the terms and conditions of the Contest, and to take all decisions it may consider useful for the application and interpretation of the regulation. Ascaron will endeavour to inform Participants through any media deemed appropriate. Ascaron reserves the right to modify, extend, reduce, suspend or terminate the Contest, without notice, due to events beyond their control, including but not restricted to events resulting of a case of force majeure or an act of God. Ascaron reserves the right to nullify and / or cancel all or part of the Contest if it appears that any fraud or malfunctions have occurred in any form whatsoever, including the operation of information technology within the framework of participation in the Contest or in the determination of the winner. In the event of fraud, abuse, or general misuse of the Contest medium, Ascaron reserves the right to prosecute the perpetrators before the Court. In the event of fraud, the perpetrator(s) will be immediately disqualified from the Contest.

8. STATEMENT OF ENTRY
By entering into the Contest the Participant declares they are the author of the submitted entry, that the submission is not the property of a third party, is free of royalties, and therefore guarantees Ascaron against all claims or convictions that might be imposed against the Participant in their use, reproduction and / or dissemination of their submission.

Upon submission of entry, the Participant extends the rights of use of their submission to Ascaron, for, but not limited to, use in the Contest, corporate and public domain, promotions and marketing, through whichever media Ascaron considers appropriate for its purpose.
